Contesting of the Refusal to Allow the Resumption of Proceedings on the Issuance of an Administrative Act

In the present study, the issue of contesting the refusal to allow the resumption of proceedings on the issuance of an administrative act, which according to Art. 103 para. 3 of the Code of Administrative Procedure can be disputed in accordance with the procedure of Chapter Ten, Section IV of this Code. More specifically, an analysis is made of the refusal to allow the resumption of administrative proceedings as a subject of dispute and the procedure for contesting it. An answer was sought to the question whether it is possible to contest the tacit refusal to allow the resumption of proceedings on the issuance of an administrative act. The question of the entities that can contest these refusals is also discussed. An analysis of legal doctrine and jurisprudence was made on the issues raised in the research.Downloads
